What We Collect

When You Contact Us

If you fill in our contact form, book a call, phone us, email us or message us on WhatsApp, we collect the details you give us. That is usually your name, email address, phone number, business name, website address and your message.

When You Become A Client

If we work together, we also keep the details we need to deliver the work and get paid: contact details, billing details, your website content and any logins you share with us for your domain, Google Business Profile, analytics or ad accounts.

When You Use Our Instant Website Review

If you ask for a free instant review, we collect your business name, website address and town (or the Google listing you pick), plus your name, email address and, if you give it, your phone number. We use them to run your review, email it to you, and get in touch about it. Our lawful basis is our legitimate interest in answering your request and following it up. The review itself looks at public information about your business, such as your website, your Google listing and reviews, and search results. Your details and your review are kept in our customer records system. To ask us to delete them, email hello@themarketing-guys.co.uk.

When You Visit Our Website

Our hosting provider keeps basic technical logs, such as IP addresses and the pages requested, to keep the website secure and running. With your consent, we also use analytics and advertising tools to understand how people use the website and which adverts bring in enquiries. Our cookie policy explains these in detail.

Why We Use It, And Our Lawful Basis

  • To reply to your enquiry and give you a price. Lawful basis: taking steps at your request before entering a contract, or our legitimate interest in responding to people who contact us.
  • To deliver the work and look after your website. Lawful basis: performing our contract with you.
  • To invoice you and keep accounts. Lawful basis: legal obligation.
  • To run your instant website review, send it to you and follow it up. Lawful basis: legitimate interests.
  • To keep our website secure. Lawful basis: legitimate interests.
  • Analytics and advertising measurement. Lawful basis: your consent, which you can withdraw at any time.

We don’t sell your data, and we don’t add you to a marketing mailing list unless you ask us to.

Who We Share It With

We use a small number of trusted suppliers to run the business. They only process your data on our instructions:

  • Cloudflare, which hosts our website and protects it from attacks, including the check that stops automated sign-ups on our instant review
  • Resend, which delivers the emails sent from our contact form
  • Google Analytics, Google Ads and Microsoft Clarity, only where you have consented to analytics and advertising cookies
  • Our SEO delivery partner, where you buy SEO from us and the work needs your website or account details

Some of these suppliers are based in, or store data in, the United States. Where that happens, the transfer is covered by the UK’s adequacy regulations or the standard contractual clauses approved for UK data.

How Long We Keep It

We keep enquiries that don’t lead to work only for as long as we need them to follow up. We keep client records for as long as we work together, and accounting records for six years after the end of the financial year they relate to, as the law requires. Analytics data is kept for 14 months.

Your Rights

Under UK GDPR you have the right to:

  • ask for a copy of the personal data we hold about you
  • ask us to correct anything that is wrong
  • ask us to delete your data, where we no longer need it
  • object to, or ask us to restrict, how we use it
  • ask us to move your data to another provider
  • withdraw your consent at any time, where we rely on it

To use any of these rights, contact us at hello@themarketing-guys.co.uk. We’ll reply within one month.

Complaints

If you’re unhappy with how we’ve handled your data, please tell us first so we can put it right. You can also complain to the Information Commissioner’s Office (ICO) at ico.org.uk or on 0303 123 1113.
